GENERAL TERMS AND CONDITIONS of Red Celebration
These General Terms and Conditions that have been made available online by the Seller on www.redcelebration.com govern all products and services between the Buyer and the Seller with respect to the use of the Website, including the purchase and sale of a product on or via the Website.
Beside these terms and conditions, there is a possibility that additional conditions could be applied on certain products and services. In case of additional conditions, they will be specifically pointed out.
When buyer orders Red Celebration to deliver one or more products, than there is a case of a legal agreement .
By using the website of Red Celebration and/or placing an order, the buyer accepts the Terms and conditions as well as the other rights and obligations that are possibly stated on the website.

Prices
The prices indicated on the Website are expressed in euros with the agreement regulations.
All the prices are included with Value Added Tax (VAT) and are exclusive of shipping costs, if not mentioned otherwise on the particular product. If the customer is not located in the country of the shipment, the customer is held responsible for any possible owed tax or import duties.
If the buyer is not a resident of the country of the shipment. , the buyer is responsible for the possible Value Added Tax (VAT) or import duties.
Special offers will only be valid on the duration time that is stated on that special offer.
Retail prices of resellers can decide their own retail prices that can differ from prices that are shown on the Red Celebration website. The resellers are responsible and can independently decide what the retail prices will be.
Red Celebration can not be held responsible for any prices that are incorrectly shown due to any typos or misprints. No rights can be granted to any incorrect pricing information
Payment.
Orders from the website that are payed through Ideal or Paypal, need to be approved by Ideal or Paypal, before Red Celebrations delivers the payed for products/services.
Red Celebration is not responsible for the payment systems of Paypal or Ideal
 
Delivery time
Red Celebration strives to send the ordered products within 24 hours after receiving the payment. These delivery times are only an indication and do not count as deadlines. Red Celebration is never accountable for damage due to exceeded delivery times.
Whenever a customer orders a product that is temporary out of stock. Than the customer will be informed when the product will be back in stock. Any delays will be communicated by phone or e-mail. The customer has the right to cancel the order immediately, when the product is not delivered within 14 days.
Red Celebration prefers to deliver via PostNL. This makes it possible to trace the orders.
Red Celebration has the right to deliver the order in parts. Any extra costs made will be paid by Red Celebration.
Red Celebration will pay for the domestic sending costs for all orders above €50.
Any orders lower than €50, there will be a shipping fee, this counts for discounted products as well.
For foreign shipments, other shipping rates will be applied. It is shown at the overview of your order when you select your country in the order process.
Red Celebration has the right to – if found necessary – call in third parties to complete the duties.
The customer is obliged to cooperate with the delivery of the ordered products, as well as receiving the products. By lack of receivement, Red Celebration has the right to let the customer pay for any extra costs that were made.
Whenever ordered products/services are made impossible to deliver, the order is than being seen as refused. The day of the refusal , will be applied as the day of delivery.

RETURNING AND THE RIGHT OF WITHDRAWAL
Agreements that have been established through the website or any other method where electronic communication has taken place, the customer has the right of withdrawal without risking a fine, after fourteen workdays after delivery. Outside this given time, we can not accept any returns.
When the customer chooses to withdraw, as stated in the previous paragraph, Red Celebration will refund the payment of the returned items.
The right of returning items will not be applied when:
-Products are not mentioned after three days of delivery
-Products that are being returned after the fourteen days time period.
-Products that are damaged by the customer
-Products that have missing attachments
-Products that are is not in the same, salable condition as the time they were delivered.
-The packaging of the items is opened.

The customer is responsible for returning the items. Red Celebration assumes that the customer returns the shipment the same way it was delivered. Postpaid returns or return shipments that have not been reported will never be taken back. Unjustified returns will be send back to the customer with the sending costs for the customer.
The customer is entirely responsible for any case of a missing returning shipment.
The costs of the return shipment of the product are for the costumer to take care of.
In case of exchanging a product, there will be one-time shipment costs being charged for the replaced product.


FORCE MAJEURE
The Seller is not liable for any damage as a result of a delay in the delivery or a failure to deliver that has been caused by circumstances that impede the Seller from complying with its obligations, and that cannot be attributed to the Seller because they can not be blamed on the Seller, and can not be deemed to be for the Seller’s account in accordance with the law, a legal act or in accordance with generally accepted standards, such as - but not restricted to - war, threat of war, civil war, riots, a day of national mourning announced by the government, strikes, transport problems, trade limitations, problems with customs authorities, fire, flooding, earthquake or the bankruptcy of third parties engaged by the Seller, a failure on the part of the Seller’s suppliers to supply goods or a failure on the part of the Seller’s suppliers to supply goods in a timely manner, interruptions in the supply of goods to be delivered by third parties, including water and electricity, and other serious interruptions in the business operations of the Seller or third parties that it engages.
If as a result of a situation involving force majeure the Seller fails to comply with its obligations under the Agreement or fails to do so in a timely manner, the Seller will be entitled to perform the Agreement within a reasonable term or – if compliance within a reasonable term is not possible – to dissolve the Agreement in whole or in part, without the Seller being obliged to pay the Buyer any compensation in that respect.


Stock
The stock in the webshop is real-time tracked. If the ordered product is not in stock by any fault, Red Celebration will than inform the customer as soon as possible. The customer has the right to cancel the ordered item. Red Celebration will than deposit the paid amount back to the customer within 14 days.

Compensation
Red Celebration is not responsible for any damage that the customer suffers, from whatever reason. Unless the damage is caused by negligence. By negligence does not mean the damage that the customer suffers due to any fault of incomplete or false information.
Customers that are opinionated that faults are made by Red Celebration, need to file their written complaint within 14 days after the damage is done, to Red Celebration. Any damage that is not filed within 14 days, will not be eligible for any refund.

If Red Celebration is responsible for damage due to shortcoming in fulfillment of the agreement of purchase and delivery, than this accountability is limited to a fee of the direct damage to a maximum of the agreed price (excluded VAT). The total compensation will be no more than €1.000,00 under any circumstances.
Any possible accountability of Red Celebration for company damage or other indirect damage, which could mean any foregone profit, missed savings, loss of data, invested time or costs by the customer or third parties, without a written permission of Red Celebration, will be excluded.

Disputes

Disputes between consumers and entrepreneurs on the creation or implementation of agreements on by providing this entrepreneur delivered or delivered products and services, may, subject as provided below, both are presented as the trader by the consumer in the European ODR commission http://ec.europa.eu/consumers/odr/

A dispute will only be dealt with by the Disputes Committee if the Consumer submitted his complaint within a reasonable time to the entrepreneur.


Privacy
Personal data is held in the customer database of Red Celebration.
Red Celebration does not pass on any personal data to third parties and will only be used for purposes for Red Celebration


Changes
Red Celebration has the right to change these general terms and conditions.
Changes to the general terms and conditions also apply to already made agreements.
In case the customer does not wish to accept the changes, the customer will then have the right to cancel the agreement until the changes are applied. When cancelling the agreement, the customer has to send a written order of cancellation that will apply to the terms in matter.
After the time the changes in terms and conditions are applied, the customer is deemed to have accepted the applied changes.
